BERLIN CHARTER TOWNSHIP

ZONING ORDINANCE AMENDMENT NO. 03-16

An Ordinance to amend the Berlin Charter Township Zoning Ordinance by modifying Section 18-305 regarding Temporary Structures to Article XV General Provisions.

PUBLIC NOTICE is HEREBY GIVEN THAT at a Regular Meeting of the Berlin Charter Township Board held on August 22, 2016, seven Board Members being present seven voting in favor none voting against, the second reading and adoption of the following proposed Ordinance Amendment No. 03-16 was introduced by M. Reaume and supported by Sovey-Meyer.

THE TOWNSHIP BOARD OF THE TOWNSHIP OF BERLIN HEREBY ORDAINS:

Section 1. Title.

This Ordinance shall be known and referred to as Berlin Charter Township Zoning Ordinance Amendment No. 03-16 revising Article XV Section 18-305.

Section 2.

Berlin Charter Township Zoning Ordinance is hereby amended by revising Section 18-305 regarding Temporary Structures as follows:

SECTION 18-305 Temporary

Buildings.

No temporary buildings shall be erected in the Township except in compliance with the following:

(1.) Temporary Dwellings. No temporary structure whether of a fixed or moveable nature, may be erected, altered or moved upon in whole or in part for any dwelling purpose for any length of time except as provided in this Section.  If a dwelling is destroyed or damaged by a natural or manmade event, such as fire, flood, windstorm or tornado, to an extent that is uninhabitable for a period of time, a temporary dwelling, including a mobile home, approved by the Township Board, may be moved on to the lot, after obtaining a permit from the building inspector for use as a temporary dwelling during replacement or repair of the permanent dwelling.  The temporary dwelling shall be placed so as to conform to all yard requirements of the zoning district in which it is located, and shall be connected to a private water supply and sewage disposal systems approved by the County Health Department or to public water supply and sewage disposal systems.

a. The Building Inspector shall establish a reasonable date for removal of the temporary dwelling; such date shall not exceed one hundred eighty (180) days from the date of issuance of such permit which shall be subject to renewal for a specific length of time approved by the Building Inspector for demonstrated cause.  In unique circumstances or cases of extreme hardships, relief may be sought under the provisions of Section 18-443.  The temporary dwelling shall be removed from the lot within two (2) weeks of the date of occupancy of the replaced or repaired dwelling with the date of occupancy to be as listed on the certificate of occupancy.  A performance bond in the amount of one thousand dollars ($1,000.00) shall be provided to ensure removal of the temporary building.

b. The Building Inspector shall provide a written statement setting forth the conditions and permissions granted under this Section to the residents so dislodged and shall retain a copy in his files.  The Building Inspector shall notify the Township Board and Planning Commission in writing of each such permission granted under this Section.

(2). Temporary Construction Structures.  Temporary buildings and/or structures may be used as construction facilities provided that a permit is obtained for such use from the Building Inspector.

Section 3.  Repeal.

All Ordinances in conflict with this Ordinance are, to the extent of such conflict, hereby repealed.

Section 4. Severability.

This Ordinance and the various parts, sentences, paragraphs, sections, subsections, phrases and clauses thereof are declared to be severable and if any of them are adjudged unconstitutional or invalid, it is hereby provided that the remainder of the Ordinance shall not be affected.

Section 5. Effective Date.

This Ordinance shall become effective seven days after adoption and publication in a newspaper having general circulation in the Charter Township of Berlin, Monroe County, Michigan.
